Violation: The Respondent's tank battery facility was a point source discharge of pollutants to  Waters of the US.   The facility is located in Wilbarger Co., TX and is known as the Waggoner  EEE  lease.  The facility was inspected by the EPA on April 25, 2007, and a violation to the Clean Water Act (CWA) and to the National Pollutant Discharge Elimination System (NPDES) Program was cited during the inspection. It was observed during the inspection that brine had been discharged from the tank battery to a tributary of Beaver Creek.

Relief: A Cease and Desist Administrative Order (AO) is being issued to the Respondent to perform the following: cease all discharges of brine from the facility; to remove the pollutant or brine from the creek; and to submit written certification the previously mentioned tasks have been completed.
