Violation: Respondent's tank battery facility was a point source discharge of pollutants to waters of the US. The facility is located in the Northeast Quarter of Section 34, Township 22 North, Range 10 East, Osage County Oklahoma. The facility was inspected on June 27, 2007, and a violation to the Clean Water Act (CWA) was cited during the inspection. The violation was the unauthorized discharge of brine to Eagle Creek.
Relief: A cease and desist Administrative Order (AO) is being issued to the Respondent to cease all discharges of pollutants from the facility; to remove the brine from the creek; and to submit written certification that the previous aformentioned tasks have been completed.
