INDCO Inc. located at 511 Essex Street, Gloucester City, NJ failed to submit a timely Toxic Release Inventory Form A report for sodium nitrite for calendar year 2004. The Respondent submitted the Form A to the EPA on April 21, 2006. The failure to submit a Form A or Form R report, in a timely manner, constitutes a violation of Section 313 of EPCRA, 42 U.S.C. Section 11023, and 40 C.F.R Section 372.30.
During settlement negotiations, the company agreed to undertake a Supplemental Environmental Project (SEP). The company has agreed to purchase Emergency Response Equipment in the amount of $3,507 for the Gloucester City Fire Department. This is a combined administrative civil complaint and consent agreement final order action with a penalty of $810, plus the above referenced SEP.
