This is a Civil Judicial Referral pursuant to the Clean Air Act. The defendants are the City of Winslow, Arizona, facility owner William Christie and former Winslow City Administrator John Roche. The complaint lists five separate violations of the National Emission Standard for Hazardous Pollutants for asbestos. First, defendants failed to give notice of the demolition of the facility. Second, defendants failed to remove asbestos-containing materials prior to demolition that would make them friable. Third, defendants failed to keep materials adequately wet after they burned the asbestos-containing materials. Fourth, defedants allowed visible emissions to emanate from the burned debris. Finally, defendants failed to keep waste shipment records. These violations resulted in emissions of asbestos, a known carcinogen. The Complaint seeks penalties of not more than the statutory maximum of $27,500 per day per violation.
