An Administrative Order was issued to Mr. Ed DeRuyter d/b/a Sunset Dairy on August 17, 2007, for violating Section 301 of the Clean Water Act. Specifically: improper handling of animal wastes; unlined feedlot storm and wastewater lagoons, and; failure to maintain documentation that waste solids and slurried lagoon wastewater is applied at crop uptake levels. Mr. DeRuyter is currently working with the State of New Mexico to develop an abatement plan to address animal waste lagoon integrity. This Order requires the facility to ensure the dairyÂs liquid & solid wastes are handled and disposed of in compliance with requirements of the NPDES general permit.
