On April 4, 2007, an Oklahoma Department of Agriculture, Food, and Forestry (ODAFF) inspector observed that pollutants from the facilityÂs small lagoon had discharged into an unnamed tributary to Middle Creek and then to Middle Creek, which is a Âwaters of the United States Respondent is Ordered to immediately cease and desist all discharges of pollutants from the facility lagoon(s), survey the capacity of the lagoon, and apply to EPA for CAFO general permit.
