This is a Civil Judicial Referral pursuant to CERCLA section 107 regarding cleanup of the Del Monte Corporation (Oahu Plantation), Superfund Site in Oahu, Hawaii. The violation involves a spill of EDB, DBCP and TCP by Del Monte Corporation at its Oahu Plantation. Del Monte Corporation is the operator at the Site while Campbell Company is the owner of the Site. The Complaint seeks to require Campbell Company LLC to implement the Institutional Controls portion of the remedial action. In a separate Consent Decree (see 09-2005-0134), Del Monte Corporation has agreed to implement the remediation of the groundwater and deep soil. The Institutional Controls implemented by the present action are required to protect the public from Site contaminants while cleanup is ongoing; to prevent interference witht the remedial action; and to provide EPA with access to the Site to oversee the remedial aciton.
