Summary

Target Corporation (Target) violated 40 C.F.R Section 82.64(d) by selling or distributing in interstate commerce nonessential string confetti products that release ozone depleting substances. These string confetti products were sold or distributed by many of Target's stores located throughout the USA. On July 21, 2006, EPA HQtrs issued an Administrative Compliance Order (No. CAA-HQ-2006-001) that required Target to find, thermally destroy and certify destruction of all nonessential string confetti products in its possession. That Order also required Target to cease importing and distributing/selling such products. Target complied with this Order and HQ's then requested that Region 2 issue and settle a penalty action with Target, on behalf of all EPA Regions, for the violations resolved by their Order. This CAFO represents a negotiated civil monetary penalty of $120,000 for Target's violations of 40 C.F.R Section 82.64(d) and is in conjunction with injunctive relief obtained through the HQtrs' Order.
