This is an administrative penalty action pursuant to the Emergency Planning and Community Right-to-Know Act (EPCRA) issued to Silver Bell Mining LLC. The Respondent self disclosed violations related to the failure to submit timely TRI reporting forms for cobalt for reporting years 2001 through 2003. Respondent failed to meet all nine criteria of the EPA Audit Policy thus it did not qualify for any penalty reduction under the Audit Policy. Accordingly, the Complaint in the action proposes a penalty of $57,900 for the violations.
