Violation: Respondent's facility was a  point source   discharge  of pollutants to  waters of the US.   The facility is a drilling location located in the Northwest Quarter of Section 36, Township 28 North, Range 9 East, Osage Co., OK.  The facility was inspected on September 21, 2007.  During the inspection the EPA inspector cited a violation to the Clean Water Act (the Act).  The violation was the unauthorized discharge of produced water (brine) to a tributary of Rock Creek.

Relief:  An Administrative Order for Compliance is being issued Ordering the Respondent to: cease all discharges of pollutants from the facility; remove all the brine from the impacted water body; install a catchment structure to catch and prevent discharges from the facility; neutralize or extract the contaminated soils; and to submit written certification that the previous mentioned activities have been completed.
