This is an administrative penalty pursuant to RCRA issued to Respondents Mr. Harvey Duro and Desert Mobilehome Park, Inc. The Facility is located in Thermal, California on the Torres Martinez Indian Reservation. The violation involves improper management of solid and hazardous wastes. This case involves the first use of RCRA Section 4005(c)(2) to enforce RCRA's prohibition against open dumping. The case also involves hazardous waste violations concerning management of used oil, universal waste batteries and CRTs. This action is initiated and concluded with a Consent Agreement and Final Order under which the Respondents agree to perform a supplemental environmental project valued at $5450 and pay a civil penalty of $1525.
