This is an administrative penalty action pursuant to RCRA issued to Respondent Scott Lawson. The Respondent's facility is located on allotment TM-19 of the Torres Martinez Indian Reservation. The violation involves improper management of solid and hazardous wastes. This case involves the use of RCRA Section 4005(c)(2) to enforce RCRA's prohibition against open dumping. This action is initiated and concluded with a Consent Agreement and FinalOrder under which the Respondent agrees to pay a civil penalty of $11,000 and is required to 1) remove and dispose of existing waste, develop and program to prevent open dumping, develop a waste management plan, and 2) develop a factsheet for local households.
