This is an administrative penalty action pursuant to Clean Air Act Section 113(d) issued toSalt River Project Agricultural Improvement and Power District. The violation involves failure to obtain valid nonattainment area PM-10 emission offsets for an expansion project at the Santan Generating Station. Respondent has has since brought the facility into compliance and the Consent Agreement/Final Order (CAFO) establishes that Respondent will pay a $12,500 civil penalty for past violations and spend $37,500 for road paving as a supplemental environmental project (SEP).
