11/15/07 - ADMINISTRATIVE COMPLIANCE ORDER ISSUED. RESPONDENTS: MR. GERALD JONES; PAINT ROCK TURF, LLC. THIS ORDER PERTAINS TO THE DEPOSITION OF DREDGED AND/OR FILL MATERIAL INTO JURISDICTIONAL WETALNDS AND WATERS OF THE U.S. INCLUDING APPROX 1,490 LINEAR FEET OF AN UNNAMED TRIBUTARY TO THE PAINT ROCK RIVER, AND APPROX 30 ACRES OF WETALNDS ADJACENT TO THE TRIBUTARY. THE DEPOSITION OCCURRED DURING MECHANICAL CLEARING AND SITE PREPARATION ACTIVITIES ASSOCIATED WITH THE EXPANSION OF A SOD FARM. ORDER REQUIRES: RESPONDENTS SHALL: A. IMMEDIATELY, CEASE PARTICIPATING IN, CAUSING, OR ALLOWING ANY ADDITIONAL DISCHARGES; B. WITHIN 48 HOURS NOTIFY EPA WHETHER OR NOT RESPONDENTS INTEND TO COMPLY WITH THIS ORDER; C. WITHIN 30 DAYS, PROVIDE A SITE RESTORATION PLAN TO EPA. THE PLAN MUST INCLUDE MEASURES TO ACCOMPLISH THE FOLLOWING - a. STABLIZE THE DISCHARGE AREA USING APPROPRIATE BEST MGMT PRACTICES; b. REMOVE UNAUTHORIZED DREDGED OR FILL MATERIAL DEPOSITED BY RESPONDENTS; c RESTORE IMPACTED WATERS OF THE U.S. AT THE DISCHARGE AREA. EPA WILL REVIEW AND PROVIDE COMMENTS ON THE PLAN; D. WITHIN 45 DAYS, SUBMIT TO EPA THE FINAL SITE RESTORATION PLAN.
