Violation: The Respondent's facility was a point source dicharge of pollutants to waters of the US. The violation was observed by an EPA inspector on February 13, 2008. The pollutant discharged was oil field brine (produced water) and the impacted water body is a tributary of Otoe Creek. The Respondent did not have NPDES program coverage to violate the CWA and discharge produced water to a water of the US.
Relief: A cease and desist Administrative Order is being issued to the Respondent to cease all discharges of pollutants; to remove fluids from a pit at the facility; remove contaminated fluids from inside the impacted water body; remediate or extract contaminated fluids; and to submit written certification.
