This is a Civil Judicial Referral for cost recovery pursuant to 42 U.S.C. 9607. The referral is to recover over $40 million in response costs incurred by EPA in cleaning up the Sulphur Bank Mercury Mine Site. The referral requests the Department of Justice to commence a CERCLA cost recovery action against Bradley Mining Company and Worthen Bradley Family Trust. Bradley Mining Company was the operator and owner of the Sulphur Bank Mercury Mine and the Worthen Bradley Family Trust is the current owner of lands contamined by mine wastes extracted from the Sulphur Bank Mercury Mine.
