The consent decree resolves the United States past cost recovery claims against Alcan Aluminum Corp. regarding the Sealand Restoration Superfund Site in Lisbon, New York. The consent decree requires that Alcan pay reimbursement of EPAÂs past response costs at the Site and a civil penalty for AlcanÂs failure to comply with an EPA administrative order issued in 1998. The consent decree provides Alcan with covenants not to sue under Sections 106(b)(1) and 107(a) of CERCLA for civil penalties related to that order and for past response costs incurred as of a date certain.
