ACTION TO RECOVER PENALTIES AND DAMAGES CERCLA 106(B) AND 107(C)(3) REGARDING THE D'IMPERIO PROPERTY SUPERFUND SITE. SPECIFICALLY, THE US EPA SEEKS TO RECOVER PENALTIES AND DAMAGES AGAINST THE DEFENDANT, A GENERATOR, FOR FAILURE TO COMPLY WITH A MODIFICATION OF ADMINISTRATIVE ORDER (AO), INDEX NO. II-CERCLA-20117.
On Jan. 7, 2000, EPA issued a Modified Administrative Order, Index No. II-CERCLA-20117 to the Defendant and other Respondents. The Modified Order required the Respondents to perform a soil study at the D'Imperio Site. The Defendant refused to comply with the Modified Order.
This Consent Decree resolves the Defendant's liability for costs and penalties stemming from its failure to comply with the Modified Order.
