DEFENDANT FAILED TO REPAIR LEAKS OF REFRIGERANT FROM THE AIR CONDITIONING SYSTEMS SERVING SUBWAY CARS IN A TIMELY MANNER; FAILED TO KEEP COMPLETE RECORDS REGARDING THE SERVICING OF THE AIR CONDITIONING SYSTEMS; AND FAILED TO HAVE OPERABLE REFRIGERANT RECOVERY AND RECYCLING EQUIPMENT ON-SITE AT THE 240TH ST. MAINTENANCE SHOP. The Defendant violated the leak repair and record keeping regulations of 40 CFR Part 82, Subpart F, promulagated under Section 608 of the CAA. Violations occurred at five NYCTA maintenance facilities. The settlement achieved for these violations comprised of a civil monetary penalty.
At the beginning of the enforcement action, there were 1,444 Redbird subway cars in service. The judicial Stipulation and Order of Settlement and Dismissal states that all Redbird subway cars have been retired from passenger service and required the Defendant to pay a civil monetary penalty.
