Dupont disclosed possible violations to EPA pursuant to EPA's insentive for Self-Policing: Discovery, Disclosure, Correction and prevention of violations about their Brine System being subject to 40 CFR 82, Subpart F, Refirgerant Leak, Repair and Recordkeeping. EPA reviewed the information submitted by Dupont and issued a final Notice of Determination (NOD) on Feb. 28, 2002. This NOD eliminated 100% of the total gravity based penalty and the amoun tof the Economic Benefit portion of the penalty was very low, therefore, EPA did not want to collect this penalty. EPA issued a compliance order to Dupont to comply with all applicable 40 CFR 82, Subpart F regulations related to their Brine System . The compliance order was issued on Feb. 26, 2002 (index number 02-2002-1009).
