THE CURRENT OWNERS OF THE WHITE BRIDGE RD PORTION OF THE ASBESTOS DUMP SITE, ARRANGED FOR THE DISPOSAL OF ASBESTOS WASTE ON THEIR PROPERTY. THIS SETTLEMENT WAS BASED ON THEIR LIMITED ABILITY TO PAY THE $8 MILLION FULL COSTS OF THE REMEDIATION, WHICH HAS BEEN COMPLETED. (EPA RECOVERED ABOUT $2.8 MILLION OF THIS COST IN AN EARLIER SETTMENT OF A BANKRUPTCY ACTION WITH THE GENERATOR, NATIONAL GYPSUM CORP.) BESIDES MAKING A PAYMENT, THE RESPONDENTS FILED A DEED NOTICE ON THE PROPERTY. THIS NOTICE IMPLEMENTED AN INSTITUTIONAL CONTROL REQUIRED BY THE RECORD OF DECISION ON THE LANDFILL AREA OF THE PROPERTY. THE RESPONDENTS ALSO AGREED TO GIVE EPA AND THE STATE UNLIMITED ACCESS TO MONITOR THE SITE AND TO DO OPERATION AND MAINTENANCE ACTIVITIES ON THE LANDFILL. THEY ALSO WAIVED THEIR RIGHT, IF ANY, TO MAKE ANY CLAIMS AGAINST THE U.S. FOR MATTERS RELATED TO RESPONSE ACTIONS AT THE SITE.
