Summary

'The purpose of this referral is to request that DOJ file a proof of claim in the VecTour, Inc., bankruptcy proceeding pursuant to the CAA to obtain penalty payment for violations of the CAA at VecTour of Florida, Inc. (VecTour) facility in Davie, FL. VecTour operates a tour bus and charter transit service and performs maintenance at its Davie, FL facility. The EPA issued a Notice of Violation letter to VecTour on July 18, 2001, alleging violations of 40 C.F.R. Part 82, Protection of Stratospheric Ozone. Based on additional information submitted by VecTour during subsequent settlement negotiations, EPA alleges 9 violations of CAA occurred. Prior to finalizing settlement negotiations for payment of a penalty, VecTour, Inc., filed a Chapter 11 voluntary petition for reorganization on October 16, 2001, in the U.S. Bankruptcy Court, District of Delaware. This petition listed VecTour of Florida, Inc., as an affiliated debtor. EPA is requesting that DOJ file a proof of claim on behalf of EPA Region 4 for the penalty amount of $72,075
