RESPONDENT FAILED TO LABEL THE HAZARDOUS WASTE CONTAINERS WITH ACCUMULATION START DATES AND FAILED TO LABEL HAZ WASTE DRUMS 2,3,4, AND 5 AND CONTAINERS 1 AND 2 WITH THE WORDS HAZARDOUS WASTE AND WITH OTHER WORDS THAT IDENTIFIED THEIR CONTENTS.
ccds: The facility violations included storage of hazardous waste w/o a permit, storage of wastes in open containers, failure to inspect hazardous wastes, failure to use hazardous waste manifests, failure to make appropriate emergency arrangements, and failure to perform a hazardous waste determination. Respondent was ordered to pay a penalty and to come into compliance. Within 45 days of the effective date of the order, the respondent was also required to submit a written notice of compliance. Respondent failed to appear at the hearing and on 9/20/02, judge gunning issued a default order assessing the full proposed penalty.
