'This case is being referred for 3 sets of violations under sections 301 and 402 of the CWA. EPA alleges that Barrett''s violated its NPDES permit for the discharge of process wastewaters consisting of drainage from its talc mine. Specifically, Barretts violated it TSS permit limit on 18 occasions from 9/94 to 6/99. Additionally, Barretts has never met the nitrate limit since the permit was issued. Barretts also chronically failed to measure its discharge flowrate from 1/98 through 1/99.'
