'Chevron Phillips owns and operates a facility engaged in petroleum refining. The facility discharges pollutants through an outfall into the Mareas Bay, a water of the United States. Chevron Phillips violated its NPDES permit, therefore, the CWA, by exceeding the effluent limitations and by failing to provide proper operation and maintenance to the facility.'
