Race Track Facility has discharged wastewater without NPDES permit authorization since 1947. Defendants to this action assumed operational control of the track in May 2001. Consent Decree would require: 1)application for NPDES permit; 2) Construction of connection to sanitary sewer; 3)BMP implementation; & 4)payment of $100,000 civil penalty.
