'This Consent Agreement and Final Order commences and simultaneously resolves a civil administrative action. NBTY, Inc. is a major source as defined by section 112 of CAA. Respondent violated Title V of the Act by failing to file a Title V Permit application on or before 12/09/97; respondent also violated 6 NYCRR section 201.2(a)-(c) and 6 NYCRR Part 233 by execeeding of the NY State Part 233 emission limitation.'
