'On August 21, 2002, U.S. EPA issued a Finding of Violation (FOV) to Southwestern. The FOV alleged that Southwestern violated reporting provisions of the Acid Rain Program. Specifically, Southwestern violated Section 412 of the Act, 42 U.S.C. � 7651k, and 40 C.F.R. � 75.62 by failing to submit a monitoring plan, 40 C.F.R. � 75.63 by failing to submit all initial certification applications and reports, and 40 C.F.R. � 75.64 by failing to submit quarterly reports. Southwestern agreed to pay a penalty of $85,492 and implement injunctive relief to resolve the violations.'
