Summary

PCB COMPLAINT FOR FAILURE TO REGISTER PCB TRANSFORMERS; FAILURE TO COMPILE AND MAINTAIN ANNUAL DOCUMENTS; AND FAILURE TO MAINTAIN RECORDS OF VISUAL INSPECTIONS. CCDS: EPA issued a Complaint against Gulf Chemical Corporation, dated Aug. 29, 2001. In such complaint EPA alleged that Respondent was in violation of Section 6(e) of TSCA and teh PCB regulations set forth at 40 C.F.R. Part 761, by owning or storing PCB items and failing to : register its PCB Transformers with EPA; compile and maintain annual document logs on the disposition of Respondent-owned PCBs and PCB Items for the years 1995 through 1998; and have records of inspections and containment on a daily basis for its PCB leaking trasnsformer for the time periods of June 29, 1999 - July 18, 1999; July 20, 1999 - Aug. 23, 1999; and Aug. 25, 1999 - Sept. 15, 1999. The CA/FO includes a cash settlement of $2,000.00 to be paid within 90 calendar days after the date of signature of the Final Order. It also includes a SEP, in which Respondent will: remove and dispose of the PCB oil contained in its PCB Transformers; flush and rinse the PCB transformers; refill such transformers with non PCB oil and test for PCB content 90 days from the date of refilling; and will remove and dispose of the PCB capacitors located at its Facility. $6,000.00 will be credited for the SEP, even though its real value is approzimatelyu $56,038.00.
