The Respondents are in violation of Section 308(a) of the CWA by its failure to comply with the application requirements for a NPDES storm water permit. The Respondents have not developed nor implemented a Pollution Prevention Plan for the Control of Erosion at the site and Sedimentation of the Caribbean Sea.'
