D&A CLEANERS WAS NOT KEEPING RECEIPTS AND A LOG OF PERC PURCHASED EACH MONTH; D&A DID NOT KEEP A LOG OF YEARLY PERC CONSUMPTION; DID NOT KEEP A LOG OF INSPECTION OF LEAKS WEEKLY; & WAS NOT KEEPING A LOG OF THE TEMPERATURE READINGS FOR THE REFRIGERATED CONDENSER. D&A FAILED TO INSPECT FOR LEAKS; FAILED TO MEASURE THE TEMPERATURE OF THE AIR-PER GAS- VAPOR STREAM ON THE OUTLET SIDE OF THE REFRIGERATED CON- DENSER ON A DRY-TO-DRY MACHINE WITH A TEMPERTURE SENSOR ON A WEEKLY BASIS TO DETERMINE IF IT IS EQUAL OR LESS THAN 45F, AS REQUIRED BY 40 CFR SECTION 63.323(A)(1) AND FAILED TO CALCULATE THE DIFFERENCE BETWEEN THE TEMPERATURE OF THE AIR- PERC GAS-VAPOR STREAM ENTERING THE REFRIGERATED CONDENSER ON A WASHER, WEEKLY TO DETERMINE THAT THE DIFFERENCE IS GREATER THAN OR EQUAL TO 20F, AS REQUIRED BY 40 CFR SECTION 63.323 (A)(2). The Respondent did not file an Answer or request a Hearing and did not pay the penalty proposed in the Complaint. EPA attempted to reach the Respondent repeatedly to settle the matter with no success. On June 21, 2004, EPA filed a Motion for Default which became final on Oct. 5, 2004. The Region will now refer this case to the US Attorney's Financial Litigation Unit in New Jersey for collection.
