Between September 14 and 25, 1999, the Respondent had a release of chemicals in amounts that were greater then the reportable quantities of chemicals as specified in 40 CFR section 302.4. The releases were not federally permitted releases. The Respondent had an obligation to report the releases to National Response Center (NRC) as required under CERCLA Section 103(a) and also to Local Emergency Planning Community (LEPC) and the State Emergency Response Commission (SERC) as required under EPCRA Section 304(a). The Respondent failed to report the releases to either NRC, LEPC, or SERC.
