This referral involves the unauthorized discharge of dredged and fill material affecting approximately ten acres of wetlands and other waters of the US. The discharges occurred in connection with construction of a residential development, golf course and private ski area at property known as The Yellowstone Mountain Club; and, with respect to proposed defendants, failure to comply with both a cease and desist order issued by the USCOE, and an order for compliance issued by EPA.
