On July 1, 2002, EPA received a letter from The Soundcoat Company, Inc. (Soundcoat) stating that they had failed to file Form R reports for toluene in 1998, 1999 and 2000, for xylene in 200 and for lead in 1998 and 1999. The facility otherwise used 14,383, 17,366 and 16,725 lbs of toluene in 1998-2000 and 10,830 lbs of xylene in 2000. The facility processed 26,244 and 27,457 lbs of lead in 1997 and 1998. Soundcoat submitted the late Form R reports to EPA on June 28, 2002. We have included this as part of our Late Reporter Initiative . The original proposed penalty was $111,934. A 75% reduction would bring the new proposed penalty to $27,984.
An informal settlement conference was held on August 5, 2002. The case was initiated and concluded simultaneously.
