Defendant violated an Early Reduction Permit (ERP) by exceeding an annual limit of 18.9 tons of HAPs for a period of 3 months. The ERP was issued in lieu of compliance with the Offsite Waste Recovery Recovery Maximum Available Control Technology (MACT) standard and is in effect until February 2006.
