Violations: 1. The SWPPP does not include a description of appropriate control measures that will be implemented as part of the construction activity to control pollutants in storm water discharges. 2. There are not adequate controls to prevent discharges of solids and building materials . 3. There are no construction-phase erosion and sediment controls designed to retain sediment on site to the extent practicable. 4. Control measures are not properly installed, selected, or maintained at the construction site. 5. Sediment is not being removed from sediment traps or sedimentation ponds when design capacity has been reduced by 50%.
6. All erosion and sediment control measures and other protective measures identified in the SWPPP are not being maintained and are not in effective operating condition.
**RELIEF SOUGHT: 1) Within thirty days, Respondents shall take whatever corrective action is necessary to correct the deficiencies, eliminate and prevent recurrence of the violations, and submit a written report detailing the specific actions taken; 2) If complete correction of the violations is not possible within thirty days, submit a comprehensive plan to do so; and 4) Within forty-five days, arrange a Show Cause meeting with EPA
