Summary

The Site was listed on the National Priorities List by publication in the Federal Register on June 10, 1986. The New York State Department of Environmental Conservation has acted as the lead agency for the Site. The owner and operator of the Site performed the remedial investigation and feasibility study, remedial design and remedial action, and is performing the operation and maintenance at the Site. EPA's actions included performance of oversight and the selection of the remedial action for the Site in a Record of Decision issued March 31, 1993. The Site remedy, which has been constructed, included capping the landfill and expanding the Johnstown City water-supply system to provide potable water to all private water supplies potentially impacted by the landfill. On December 3,2002,EPA issued a proposed CERCLA Agreement for Payment of Response Costs with seven responsible parties at the Johnstown City Landfill Superfund Site, located in Johnstown, New York. The proposed Agreement requires the Respondents pay the past costs at the Site. The covenant not to sue in the Agreement is for past costs only.
