On June 30, 2003, the United States Environmental Protection Agency - Region III issued an Administrative Complaint, Compliance Order and Notice of Opportunity for a Hearing ( Complaint ) against Amsted Industries, Inc. d/b/a Griffin Pipe Products Co. ( Respondent ) the owner and operator for a foundry facility located at 10 Adams Street, Lynchburg, VA ( Facility ). The Complaint is filed pursuant to Section 3008(a)(1) and (g) of the Resource Conservation and Recovery Act ( RCRA ), 42 U.S.C. Section 6928(a)(1) and (g), and 40 C.F.R. Part 22 of the Consolidated Rules of Practice.
The Complaint alleges, inter alia, that Respondent, as a generator of solid and hazardous wastes, was operating without a permit. Furthermore, the Complaint alleges that Respondent failed to keep containers of hazardous waste closed, provide training to its facility personnel and/or to maintain training documents, maintain a secondary containment system, remove from service and/or repair or certify baghouse tank, and maintain its Facility so as to minimize the possibility of a hazardous waste release. Respondent has been ordered to remedy the aforementioned violations upon the effective date of the Compliance order and a total recommend civil penalty has been set at $53,3
