CAFO issued 2/25/2003, assessing a zero penalty. Respondent failed to submit the report on or before the March 1 due date. EPA did not receive the report until 11/24/2002. The Respondent reported zero production of the pesticide product and has no plans to product the product in the near future. The assessment of 0 civil penalty is appropriate in this matter.
