This is an AO pursuant to the Clean Water Act issued to BK Powder Coating, which is a categorical industrial user of the Grass Valley sewer system. Grass Valley does not have an approved pretreatment program because of its small size and has not issued a valid sewer discharge permit to BK Powder Coating. The violation involves the failure to monitor for the pollutants regulated by the Federal standards for metal finishing. The Order directs BK Powder Coating to begin a years worth of self-monitoring in order to demonstrate compliance with the Federal standards. Since EPA cannot issue a permit to an indirect discharger to a sewer system, it is expected that either the City of Grass Valley will be required by the RWQCB to obtain an approved pretreatment program and as a result issue a valid permit to BK Powder Coating, or the RWQCB will issue the permit to BK Powder Coating under its own authority. This AO is one of several issued to categorical industrial users in small cities without approved pretreatment programs.
