CAFO issued 2/28/2003, assessing a penalty zero penalty. Respondent did not submit the annual report for 2001 on or before March 1, 2002. Respondent has asserted that the required report was timely sent to Complainant and has produced a written statement in support of that assertion. Notwithstanding Respondent's assertion, EPA did not receive the report until August 19, 2002.
