On March 21, 2003, Region 3 signed a Consent Agreement and Final Order (ACAFO@) simultaneously commencing and resolving violations against Exelon Generation Company, LLC (Exelon). The CAFO resolves a single day of opacity violations occurring on July 29, 2002 at Exelon's Delaware Generating Station located in Philadelphia, Pennsylvania. On that day Exelon's air emissions exceeded the level allowed by its Title V operating permit during ten discrete periods at two different smoke stacks over the course of the day. Exelon will pay a $20,000 penalty and undertake voluntary measures, that along with certain steps already completed, will reduce the potential for future opacity violations
