Summary

This is an administrative penalty action issued pursuant to Section 109 of CERCLA, as amended, 42 U.S.C. � 9609; and Section 325 of EPCRA, 42 U.S.C. � 11045, addressing violations of CERCLA Section 103, 42 U.S.C. � 9603, and EPCRA Section 304, 42 U.S.C. � 11004, by Hadco Corp. (a subsidiary of Sanmina-SCI Corp.) at its facility in Phoenix, Arizona. The violations concern the May 15, 2000 release of 165 lbs of chlorine and the November 21, 2000 release of 20 lbs of cupric chloride. Hadco failed to immediately notify the NRC of both the May 15, 2000 release of chlorine and the November 21, 2000 releases of cupric chloride, in violation of CERCLA Section 103, 42 U.S.C. � 9603. Hadco also failed to immediately notify the SERC and the LEPC of the May 15, 2000 chlorine release in violation of EPCRA Section 304, 42 U.S.C. � 11004. Each failure to notify is a separate violation. This administrative penalty action is being simultaneously initiated and concluded pursuant to 40 C.F.R. Section 22.13(b) with a combined complaint/consent agreement/final order (CA/FO). Under the terms of the CA/FO, Hadco will pay a $20,000 civil penalty and perform a SEP.
