Summary

On June 6, 2003, EPA Region III issued an administrative complaint to Fred H. Jones, d/b/a Fred Jones Well Co. ( Fred Jones ), seeking a total penalty of $10,224.50 for violations of Section 311(j) of the CWA. Fred Jones failed to prepare an SPCC Plan for his water well-drilling and pump installation facility located in Appomattox, Virginia, which has an above-ground storage capacity of 6,000 gallons for petroleum products. The facility is located within one-half mile of an unnamed stream that ultimately flows into the Appomattox River. Fred Jones' failure to develop an SPCC Plan limits his ability to prevent and/or control spills at his Facility that could adversely impact the Appomattox River. Despite two inspetions by EPA and a notice of noncompliance providing Fred Jones more time to prepare an SPCC Plan, as of the dat eof the filing of the complaint, he has not prepared an SPCC Plan
