## Summary

Violations:  The Respondent' tank battery facility was a  point source   discharge  of  pollutants,  specifically brine, to the receiving waters of a tributary of Ash Creek, located in the Northeast Quarter of Section 9, Township 15 North, Range 15 East, Muskogee County, Ok.  The discharge of brine was documeted during a May 20, 2003, inspection.

RELIEF:  The Order specifies that the Respondent should also take steps to cease all discharges of pollutants and to neutralize the brine contaminated area south of the tank battery by applying soil amendments to neutralize the sodium chloride.  Additionally, the Order asks the Respondent to consider: (1)constructing adequate secondary containment; (2) installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; and (3) conscientiously monitor the fluid levels in the salt water tank.  A follow-up inspection will determine the extend of compliance with the Order.
