EPA inspected Anderson Dairy and found that this facility did not have a lagoon for containing its process-generated wastewater. EPA issued an Administrative Order requiring the facility to take all necessary measures to prevent any discharge of pollutants to waters of the U.S. and to submit to EPA documentation to prove that the facility has adequate capacity to contain all process-generated waste and wastewater plus runoff generated during the 25-year, 24-hour storm event. The Order also required the facility to initiate a weekly visual inspection program to determine if any discharges are occurring. This visual inspection program shall continue until the facility applies for, and obtains, an NPDES CAFO permit. The Order required the facility to arrange a meeting with EPA to address the violations specified in the Order.
