On June 30, 2003, EPA issued an administrative complaint against Northstar Petroleum Company and Jack R. Schooley (the Respondents ), the owner and operator of a a facility known as Schooley's Auto Service, respectively, located at 4101 Stuebenville Pike, Pittsburgh, PA, (the Facility ). The Complaint is to be filed pursuant to Section 3008(a) and (g) of the Resource Conservation and Recovery Act ( RCRA ), 42 U.S.C. Section 6928(a) and (g).
Respondents failed to provide release detection method for USTs Nos. 1 through 3b at the Facility that meets the performance requirements of 40 C.F.R. Section 280.34(d) through (h), failed to underground piping that routinely contains regulated substances for USTs Nos. 1 through 3 that meets the requirements of 40 C.F.R. Section 280.44(b) or (c) or 280.43(e) through (h), and failed to provide corrosion protection to the metal components of USTs at the Facility that routinely contain regulated substances and are in contact with the ground as required by 40 C.F.R. section 280.21.
Respondent Jack Schooley has demonstrated inability to pay the proposed penalty of $11,000. As a result, the assessed penalty was $0.00.
