Respondents placed fill in wetland are (<0.10 acre) for the purpose of constructing a driveway for upland access to a building lot. Respondent shave expressed interest in applying for the appropriate permit to authorize this activity. The AO will require the respondents to either obtain the proper permit (NWP18 for up to 0.10 acre of fill) or restore the weltand.
