EPA has determined the proposed penalty of $137,500 against the Puerto Rico Aqueduct and Sewer Authority concerning the Jardines del Torito Wastewater Treatment Plant for failure to meet effluent limitations set forth in the National Pollutant Discharge Elimination System (NPDES) permit, for the unlawful discharge of untreated or partially treated sewage (wastewater bypasses) into the La Plata Rivera, navigable waters of the United States, failure to provide proper operation and maintenance to the plant, and for not reporting EPA instances of noncompliance, all against its NPDES permit. The violations taken in the Complaint occurred within the period of May 1, 2001 and February 28, 2003.
