Respondent failed to submit Tier II reports for the year 2001 for BIS-3 (Aminoprophyl Piperazine), Cuprous Chloride, Specialty Blue Dispersion (BCD9131), and Phatalocyanine Green Paint Flush (6644267) to the state emergency response commission (SERC), the local fire emergency planning committee (LEPC), and the fire department with jurisdiction over the facility as required by Section 312 of EPCRA. On November 25, 2002, UPS submitted the Tier II reports for calendar 2001 to the SERC, LEPC, and fire department.
